The SVO supports amending AB-5 by Assembly Appropriations Chair, Assemblywoman Lorena Gonzalez-Fletcher, to allow flexibility in California’s implementation of the recent CA Supreme Court ruling on Dynamex through various industry exemptions that the bill would apply to.

The Dynamex Decision lays out the ABC test for determining if an employer can classify a worker as an independent contractor. If AB-5 is passed as currently written, it would prove to be onerous and costly for many businesses who rely on labor from independent contractors as it would require independent contractors like nail salon workers to be classified as employees thus entitling them to benefits and other resources.
